These Terms and Conditions ("Terms") govern your access to and use of the Formula Beauty Club website at formulabeauty.club ("Site") and all related services, products, and membership programs offered by Formula Beauty Club ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

Eligibility. You must be at least 18 years of age to use the Site or make a purchase. By using the Site, you represent that you meet this requirement.

Permitted Use. You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Site or its related systems
• Copy, scrape, or reproduce any content from the Site without our prior written consent
• Use the Site to transmit spam, malware, or any harmful content

Account Responsibility. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at care@formulabeauty.club if you suspect unauthorized use.

Changes to the Site. We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice.

2. Orders & Payment

Placing Orders. By placing an order on the Site, you represent that the information you provide is accurate and complete. We reserve the right to refuse or cancel any order at our discretion.

Pricing. All prices are listed in US dollars. Prices are subject to change without notice. The price charged for an order will be the price in effect at the time of purchase.

Payment. Full payment is required at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout. We do not store your full payment card details.

Order Confirmation. An order confirmation sent to your email does not constitute acceptance of your order. We reserve the right to cancel confirmed orders in the event of pricing errors, stock issues, or suspected fraud, and will provide a full refund in such cases.

Taxes. You are responsible for any applicable taxes on your purchases. Sales tax will be applied where required by law.

Returns & Refunds. We accept returns on unopened, unused products within 14 days of delivery. Products must be in original condition and packaging. To initiate a return, contact us at care@formulabeauty.club or call/text +1 940 326 5064. Refunds will be issued to the original payment method within 5–10 business days of receiving the returned item. We do not accept returns on opened or used products unless they arrived damaged or defective.

Damaged or Incorrect Items. If your order arrives damaged or you receive the wrong item, contact us within 48 hours of delivery. We will replace the item at no additional charge.

3. Membership

Membership Tiers. Formula Beauty Club offers membership programs with different tiers and associated benefits. Details of each tier, including pricing, perks, and eligibility, are described on the Site and are subject to change.

Membership Fees. Membership fees are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). By subscribing, you authorize us to charge your payment method automatically at the start of each billing period.

Cancellation. You may cancel your membership at any time by contacting us at care@formulabeauty.club, by calling or texting +1 940 326 5064, through your account dashboard, or directly through your personal concierge manager. Cancellation takes effect at the end of the current billing period. We do not offer partial refunds for unused portions of a billing period.

Member Benefits. Member benefits — including pricing, free shipping, and access to the personal concierge service — are available only during an active membership. Benefits are non-transferable and apply to the registered account only.

Termination by Us. We reserve the right to suspend or terminate any membership account for violation of these Terms, fraudulent activity, or conduct detrimental to the Formula Beauty Club community, with or without prior notice.

Founding Member Rate. Members who join through the waitlist prior to the official launch on September 1, 2026 will be offered a special founding member rate. This rate will be communicated at the time of the membership offer and locked in for the duration of continuous membership.

4. Intellectual Property

Ownership. All content on the Site — including but not limited to text, images, logos, graphics, product descriptions, and the overall design — is the property of Formula Beauty Club or its licensors and is protected by applicable intellectual property laws.

Trademarks. The Formula Beauty Club name, logo, and tagline "Behind every successful beauty business is the right formula." are trademarks of Formula Beauty Club. You may not use them without our prior written consent.

Restricted Use. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our express written permission. Downloading content for personal, non-commercial reference is permitted.

User-Submitted Content. If you submit any content to us (such as reviews or feedback), you grant Formula Beauty Club a non-exclusive, royalty-free, worldwide license to use, display, and publish that content in connection with our business.

5. Disclaimers & Limitation of Liability

As-Is Basis. The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses.

Product Use. All products sold through the Site are intended for professional use. It is your responsibility to ensure that any product is appropriate for your intended use and that you and your clients are not allergic or sensitive to any ingredients.

Limitation of Liability. To the fullest extent permitted by law, Formula Beauty Club shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the order giving rise to the claim.

6. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.

7. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
